Drago Kos is currently the Chair of the OECD Working Group on Bribery in International Business Transactions, Co-Chair of MENA – OECD Business Integrity Network, member of International Anti-Corruption Advisory Board (IACAB) and of the Defence Corruption Monitoring Committee (NAKO) in Ukraine and advisor to the Kosovo Anti-Corruption Agency. Between 2011 and 2015 he used to be International Commissioner and Chair of the Joint Independent Anti-Corruption Monitoring and Evaluation Committee (MEC) in Afghanistan. Dr. Harald Sippel, MBA SFBiam FCIArb acts as a Senior Legal Advisor for Schinder Law Firm, a Founding Partner at Putilin Sippel and the Academic Director at the Bali International Arbitration and Mediation Center. With over 10 years as an international lawyer, in-house counsel and C-level executive in international organizations dedicated to dispute resolution, Harald’s main focus of work is assisting companies in avoiding and resolving cross-border disputes. He also acts as an arbitrator and mediator himself.
Harald has worked for law firms, international organizations and companies in Austria, China, Germany, Indonesia, Korea and Malaysia and is now based in Southeast Asia, from where he advises foreign investors and local multinationals. Many of his clients include companies dealing with supply change disruptions – a topic on which he frequently speaks and writes.
Harald holds degrees from the University of Linz (Magister iuris; Doctor iuris), the Seoul National University (MBA) and Queen Mary, University of London (Postgraduate Diploma in International Arbitration). Topic: Key Legal Challenges to Consider When Thinking About Supply Chain Shift

Changing your supplier immediately may seem the best option but you should assess all risks before taking any action. There are four broad risk categories associated with a possible supply chain shift:

  • Contractual risks (termination periods, notice periods, contractual penalties for contract termination, etc.)
  • Compliance risks (compliance with foreign and local laws – you don’t want to be on the news for modern slavery)
  • IP-rights risks (what will your old supplier do with respect to patents, trademarks, business secrets, etc.)
  • Other legal risks (bribery, reputational damage to the extent that your business partners demand changes, etc.)

Each category requires different considerations and a different approach. Companies often do not spend the small money on assessing the risks and end up losing the big bucks when getting tangled up in disputes.
